These Terms of Service govern your use of Apex Driion's luxury transportation services in Singapore. By accessing our website or using our services, you agree to be bound by these terms and conditions.

Service Terms and Conditions

1. Service Availability and Booking

1.1 Eligibility: Services are available to individuals and organizations aged 18 years or older. Bookings made by minors must be accompanied by parental or guardian consent.

1.2 Booking Process: All service requests must be submitted through our website, phone, or authorized booking channels. Confirmation is provided upon acceptance of booking terms and payment verification.

1.3 Service Areas: Our services operate throughout Singapore and may extend to Johor Bahru, Malaysia, subject to advance notice and additional terms.

1.4 Availability: While we strive for 24/7 availability, services are subject to vehicle and chauffeur availability, weather conditions, and operational constraints.

1.5 Minimum Age: Passengers under 18 must be accompanied by an adult unless prior arrangements have been made with parental consent and appropriate safety measures.

2. Payment Terms and Pricing

2.1 Pricing: All prices are quoted in Singapore Dollars (SGD) and include applicable taxes unless otherwise specified. Prices may vary based on service type, duration, and special requirements.

2.2 Payment Methods: We accept cash, major credit cards, bank transfers, and corporate billing arrangements. Payment must be secured before service commencement unless pre-approved credit terms apply.

2.3 Additional Charges: Extra fees may apply for waiting time exceeding 15 minutes, route changes, additional stops, toll charges, parking fees, and services outside standard operating hours.

2.4 Currency: International clients may be quoted in their local currency, but final billing will be processed in Singapore Dollars at prevailing exchange rates.

2.5 Corporate Accounts: Extended payment terms may be available for qualified corporate clients with established credit arrangements and signed service agreements.

3. Cancellation and Refund Policy

3.1 Standard Cancellations: Cancellations made 24 hours or more before scheduled service time will receive a full refund minus processing fees.

3.2 Short Notice Cancellations: Cancellations made less than 24 hours before service time may incur a 50% cancellation charge to cover operational costs.

3.3 No-Show Policy: Failure to appear for scheduled service without prior notice will result in full charge for the reserved service period.

3.4 Weather and Force Majeure: Services cancelled due to extreme weather, natural disasters, or government restrictions will be rescheduled or fully refunded at client discretion.

3.5 Multi-Day Services: Extended rental and diplomatic services have specific cancellation terms outlined in individual service agreements.

Client Responsibilities and Conduct

4. Prohibited Activities

Clients agree not to engage in the following activities:

Safety Violations

  • • Interfering with vehicle operation or chauffeur duties
  • • Consuming illegal substances or excessive alcohol
  • • Smoking in vehicles (including electronic cigarettes)
  • • Bringing weapons or dangerous materials
  • • Exceeding vehicle passenger capacity limits

Conduct Violations

  • • Harassment or inappropriate behavior toward staff
  • • Damage to vehicles or company property
  • • Illegal activities or transportation of contraband
  • • Providing false information during booking
  • • Violating Singapore laws and regulations

5. Client Information and Accuracy

5.1 Information Accuracy: Clients must provide accurate and complete information during booking, including contact details, pickup locations, and special requirements.

5.2 Updates and Changes: Any changes to booking details must be communicated immediately to ensure proper service delivery and safety protocols.

5.3 Identification: Valid identification may be required for certain services, particularly diplomatic transport and cross-border travel.

5.4 Special Requirements: Clients must disclose any special needs, accessibility requirements, or health conditions that may affect service delivery.

5.5 Contact Availability: Clients must remain reachable via provided contact information throughout the service period for coordination and safety purposes.

Service Limitations and Disclaimers

6. Limitation of Liability

6.1 Service Disclaimer: While we strive to provide excellent service, Apex Driion makes no warranties regarding uninterrupted or error-free service delivery. Services are provided "as is" within reasonable commercial standards.

6.2 Liability Limits: Our total liability for any claim related to our services shall not exceed the fees paid for the specific service in question, except where prohibited by Singapore law.

6.3 Indirect Damages: We shall not be liable for indirect, consequential, or punitive damages including lost profits, business interruption, or reputational harm.

6.4 Third-Party Actions: We are not responsible for actions of third parties, including other road users, government authorities, or external service providers beyond our direct control.

6.5 Insurance Coverage: All vehicles carry comprehensive commercial insurance as required by Singapore law, providing coverage for accidents and damages within policy limits.

7. Force Majeure

7.1 Covered Events: Neither party shall be liable for delays or failures in performance due to circumstances beyond reasonable control, including natural disasters, government actions, strikes, or technical failures.

7.2 Notification: We will promptly notify clients of any force majeure events affecting their services and work to provide alternative solutions where possible.

7.3 Service Alternatives: During force majeure events, we will attempt to provide alternative transportation options or reschedule services at no additional cost.

7.4 Refund Policy: If alternative arrangements cannot be made, full refunds will be provided for services that cannot be delivered due to force majeure events.

Intellectual Property and Privacy

8. Intellectual Property Rights

8.1 Company Property: All content on our website, mobile applications, and marketing materials, including logos, trademarks, text, images, and software, remain the exclusive property of Apex Driion.

8.2 Limited License: Clients are granted a limited, non-exclusive license to use our digital platforms for booking and accessing services. This license does not permit reproduction or commercial use of our content.

8.3 Trademark Usage: The Apex Driion name, logo, and associated trademarks may not be used without prior written permission from our legal department.

8.4 User-Generated Content: By providing feedback, reviews, or other content, you grant Apex Driion a non-exclusive right to use such content for business purposes, including marketing and service improvement.

9. Privacy and Confidentiality

9.1 Data Protection: Personal information is collected and processed in accordance with our Privacy Policy and Singapore's Personal Data Protection Act (PDPA).

9.2 Confidentiality: We maintain strict confidentiality regarding client information, conversations, and travel details, particularly for diplomatic and corporate services.

9.3 Data Security: All personal and payment information is protected using industry-standard security measures and encrypted transmission protocols.

9.4 Information Sharing: Client information is never shared with third parties except as required by law or necessary for service delivery (such as payment processing).

Dispute Resolution and Governing Law

10. Complaint Resolution Process

Direct Resolution

Contact our customer service team within 7 days of service completion. We aim to resolve 90% of issues through direct communication.

Mediation

If direct resolution fails, disputes may be referred to the Singapore Mediation Centre for neutral mediation services.

Legal Proceedings

Unresolved disputes will be subject to the jurisdiction of Singapore courts under Singapore law.

11. Governing Law and Jurisdiction

11.1 Applicable Law: These terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.

11.2 Jurisdiction: The Singapore courts shall have exclusive jurisdiction over any disputes arising from or relating to these terms or our services.

11.3 Regulatory Compliance: Our services operate under the authority of the Land Transport Authority (LTA) of Singapore and comply with all applicable transportation regulations.

11.4 International Clients: Foreign clients acknowledge that Singapore law applies regardless of their country of origin or residence.

General Provisions

12. Terms Modification and Communication

12.1 Modifications: We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated effective date.

12.2 Notification: Material changes will be communicated to active clients via email or account notifications at least 30 days before taking effect.

12.3 Continued Use: Continued use of our services after term modifications constitutes acceptance of the updated terms.

12.4 Version Control: Previous versions of these terms are archived and available upon request for reference purposes.

13. Severability and Entire Agreement

13.1 Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13.2 Entire Agreement: These terms, together with our Privacy Policy and specific service agreements, constitute the complete agreement between you and Apex Driion.

13.3 No Waiver: Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

13.4 Assignment: You may not assign your rights or obligations under these terms without our written consent. We may assign our rights and obligations with appropriate notice.
